1. Introduction and Acceptance

Welcome to Speedra (“Service,” “App,” “we,” “us,” or “our”). By accessing or using our Service, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use our Service.

Speedra is a GPS-based speedometer application for informational and entertainment purposes. Speed readings are estimates based on GPS data and should not be relied upon as the sole measurement of your speed.

By installing or using the App, you confirm you have the authority to enter these Terms.

You represent and warrant that you are at least 13 years old. If you are under 18, you affirm you have parental or legal guardian consent to use the Service.

2. Description of Service

Speedra provides:

• Real-time GPS-based speed measurement
• Trip tracking and statistics
• Live Activity and Dynamic Island integration
• Heads-Up Display (HUD) mode
• Various secondary displays (map, compass, G-force)

Important: Speed readings are for informational purposes only and may not match your vehicle’s speedometer exactly. GPS accuracy varies based on signal strength, environmental conditions, and device capabilities.

3. Acceptable Use Policy

3.1 Permitted Uses

You MAY use Speedra for:

• Personal speed monitoring while driving, cycling, or other activities
• Tracking trips and reviewing statistics
• Entertainment and informational purposes

3.2 Prohibited Uses

You MUST NOT:

• Operate the app in a way that distracts you from safe driving
• Rely solely on Speedra for legal speed compliance
• Use Speedra as evidence in legal disputes about speed

Misuse

• Modify, reverse engineer, or decompile the app
• Use the app to circumvent speed detection or enforcement
• Share your account credentials with others

3.3 Driver Responsibility

You acknowledge and agree that:

• You are solely responsible for safe vehicle operation
• You must comply with all traffic laws and speed limits
• Speedra is not a substitute for your vehicle’s speedometer
• You should not interact with the app while driving—set it up before you start

4. Disclaimers and Limitations

4.1 GPS Accuracy

GPS-based speed measurement:

• May have delays or inaccuracies
• Is affected by signal strength, tunnels, buildings, and weather
• Should not be used for legal or official purposes
• May differ from your vehicle’s speedometer

4.2 Service Provided “As Is”

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING:

• Accuracy of speed readings
• Uninterrupted or error-free operation
• Fitness for a particular purpose

4.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• We are not liable for any accidents, injuries, or damages arising from use of the app
• We are not liable for any traffic violations or legal consequences
• We are not responsible for GPS inaccuracies or signal loss
• Our total liability is limited to the amounts you paid for the Service in the six (6) months preceding the claim

5. Intellectual Property

5.1 Service Content

All Service elements (software, design, branding) remain our exclusive property. No ownership or intellectual property rights are transferred to you.

5.2 Feedback

If you provide suggestions or feedback, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use it without restriction.

6. Privacy and Data

6.1 Location Data

• Your location is processed on-device to calculate speed
• We do not track or store your location on our servers
• Trip data is stored locally on your device

7. Subscription and Payments

7.1 Free Features

• Basic speedometer functionality
• Limited feature access

7.2 Speedra Pro

• Billed through Apple App Store
• Subject to Apple’s payment terms and refund policies
• Auto-renews unless cancelled at least 24 hours before renewal date
• Manage or cancel in Settings > [your name] > Subscriptions
• Price changes follow Apple’s notice process

7.3 Subscription Terms

• No refunds for partial periods beyond Apple’s policies
• Restore subscriptions from your Apple ID using App Store restore flows
• Deleting the app does not cancel your subscription

8. Apple App Store Terms

8.1 License

• This is a Custom EULA for Speedra distributed via the Apple App Store
• You must also comply with Apple’s App Store terms
• Your license is granted by Speedra (Application Provider)

8.2 Scope

• Nontransferable license to use the app on Apple devices you own or control
• No reverse engineering, copying, or modification except where legally permitted

8.3 Third-Party Beneficiary

• Apple and its subsidiaries are third-party beneficiaries of this EULA
• Apple has no obligation to furnish maintenance or support

9. Account Termination

9.1 By You

You may stop using the app at any time. To cancel your subscription, manage it through your Apple ID settings.

9.2 By Us

We may suspend or terminate your access if:

• You violate these Terms
• Required by law
• The Service is discontinued

10. Dispute Resolution

10.1 Governing Law

These Terms are governed by the laws of Brazil, without regard to conflict of law principles.

10.2 Disputes

Any disputes shall be resolved through binding arbitration where permitted by law, except for intellectual property disputes or emergency injunctive relief.
